1. Registration and Personal Information

By registering as a customer, you agree to provide accurate and complete personal information, including your name, email address, mobile number, address, and vehicle details. We collect this information to facilitate the provision of our services and ensure a seamless experience for you.

2. Acknowledgment of Terms

By accepting our service, you acknowledge that you have read, understood, and agreed to these terms and conditions. It is your responsibility to be aware of and comply with these terms during the service period.

3. Essential Documents

You must ensure that the vehicle being used for the service possesses valid documents, including the RC book, insurance copy, and Pollution Under Control (PUC) certificate. These documents are mandatory and vital for a smooth service experience.

4. Safety Precautions

You agree not to cause any distractions or disturbances during the service, ensuring both your safety and the driver’s safety on the road. Distractions, whether verbal or otherwise, can compromise the safety of everyone involved.

5. Tinted Glasses and Dark Films

We are not responsible if your vehicle has tinted glasses or dark films that lead to police intervention or penalties.

6. Service Description

Work Hard Drivers operates as an aggregator platform, connecting Customers with nearby Drivers willing to provide designated-driving services. While we strive to ensure timely service, various factors may affect service quality. We do not accept responsibility for delays unless they are purposeful. Our drivers will wait for a maximum of 30 minutes at the specified location; any delay beyond this period will result in the trip starting, and charges will apply.

7. Booking and Cancellation

You may cancel bookings up to 45 minutes before the scheduled journey without incurring cancellation charges. Cancellations made after the driver has started toward your location will incur a cancellation fee of ₹250/-, payable directly to the driver.

8. Payment and Refunds

Upon trip completion, the fare amount will be displayed on your mobile device, and you can pay either in cash or through electronic means, subject to the driver’s agreement. Any payment-related issues, except those caused by our platform, should be resolved directly between you and the payment processor. Work Hard Drivers is not liable for unauthorized use or false claims.

9. Limitation of Liability

The driver’s responsibility is confined to operating your vehicle safely. Work Hard Drivers does not assume any liability for fire, theft, loss, or damage to personal belongings. Additionally, the driver cannot be held responsible for injuries resulting from faulty brakes or poor vehicle condition.

10. Termination and Access

Work Hard Drivers reserves the right to deny access, limit features, or terminate accounts without prior notice if users violate these terms, mistreat drivers in any manner that endangers safety or well-being, provide false information, interfere with others’ use, or in case of technical issues. Certain provisions, including Intellectual Property Rights and Prohibited Uses, will remain in effect even after account termination.

11. Indemnity

You agree to defend, indemnify, and hold Work Hard Drivers, its affiliates, licensors, and employees harmless from any claims, costs, damages, and liabilities arising from violation of this Agreement or applicable laws, third-party rights, or misuse of the platform.

12. Miscellaneous

This Agreement constitutes the entire agreement between you and Work Hard Drivers regarding the use of our platform. We reserve the right to update our Terms and Conditions without notice. Users are responsible for reviewing the latest terms.

13. Jurisdiction

Any disputes arising from the use of our services shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.

14. RTO Challan

You are responsible for any challans issued due to vehicle condition or factors beyond the driver’s control, including but not limited to: toll or entry tax; vehicle-document issues; fines for commercial usage or overloading; violations for restricted-area entry or illegal parking as per your instructions; breakdown or towing charges resulting from your negligence.

15. Parking Responsibility

You should instruct the driver to park only in designated parking areas. If an RTO or police challan is issued due to improper parking, the client will be responsible for paying the fine.
